JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Parasbigha P.S. case No. 94 of 2017 registered for the offence punishable under sections 302, 201 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. There is no eye witness to the alleged occurrence. The deceased might have died due to accident. Further, no hooking of wire for extracting electrical energy for domestic use can be made in any case from High Tension/High Voltage Line. This fact finds support by paragraph 13 of the case diary. No offence under section 302 I.P.C. is made out. At best, it can be case under section 304A I.P.C. Petitioner has no criminal antecedent. No.43996 of 2017(3) dt.12-10-2017 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. bharti, Judicial Magistrate, 1st Class, Jehanabad in connection with Parasbigha P.S. Case No. 94 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
