In this case, the petitioner is seeking anticipatory bail in connection with Ara (Nawada) P.S. Case No.217 of 2019, registered for the offence punishable under Section 381 of the Indian Penal Code.
Allegation has been made that master of the house left his son has gone outside to attend some function, when he returned, he found that some ornaments were taken away by his maid servant. It has further been alleged that the maid servant accepted her guilt and on giving impression to return the ornaments, she left place and thereafter, she never returned. Counsel for the petitioner submits that admission of
Patna High Court CR. MISC. No.44753 of 2019(2) dt.22-07-2019 2/2 offence is not correct as the son of the master of the house was present in the house and it is not supposed that she will open the locker and take only part of the ornament and will close the same.
Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in connection with Ara (Nawada) P.S. Case No.217 of 2019 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that whenever the police will call the petitioner for the purposes of investigation and interrogation, she will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
