The petitioner seeks bail in connection with Siwan Town P. S. Case No. 711 of 2018 dated 12.11.2018 instituted for the offences under Sections 414 / 34 of the Indian Penal Code and Section 25(1-B)a/26/35 of the Arms Act, 1959 and 30(a) of Bihar Prohibition and Excise Act, 2016.

Small quantity of liquor and fire arms is said to have been recovered from a room of a lodge in which the petitioner resided. This is the basis for his prosecution in the instant case.

Patna High Court CR. MISC. No.44885 of 2019(3) dt.13-09-2019 2/2 Learned counsel for the petitioner has submitted that the lodge in question is occupied by other persons also. Considering the circumstances in which the petitioner has been made accused in this case and the period of custody, which is from 11.03.2019, this petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Siwan in connection with Siwan Town P. S. Case No. 711 of 2018.
