2. In the present case, the petitioner seeks bail in connection with Sohsarai P.S. Case No. 106 of 2026 dated 17.04.2026, registered for the offences punishable under Sections 318(4), 319(2), 336(3), 338 and 340(2) read with Section 3(5) of the B.N.S., 2023 and Sections 3, 10, and 11 of the Bihar Public Examinations (Prevention of Unfair Means) Act, 2024.
3. As per the prosecution case, the petitioner was apprehended supplying chits to co-accused Sweta Kumari during the examination of Assistant Education Development Officer.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

The petitioner was engaged in biometric work and for this reason, he was present at the examination centre. Nothing incriminating was recovered from the possession of this petitioner. There is no material to show that he was involved in any manner in helping the candidate with unfair means. Learned counsel next submits that petitioner is having antecedent of two cases and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 18.04.2026.
5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering petitioner's period of custody and submission of chargesheet against him, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Biharsharif, Nalanda/ concerned Court, in connection with Sohsarai P.S. Case No. 106 of 2026, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
