No.50638 of 2014 within course of the day.
All the above stated three petitions are taken en- bloc as all the petitions arise out of Sahebganj P.S.Case No. 175 of 2014 registered under section 147,148,149,341,323,307,302,427 and 120(b) of the Indian Penal Code and section 27 of the Arms and section 3(2) (v) of SC/ST Act and section 17 of C.L Act and, accordingly, all the above stated petitions are being disposed of by this common order.
Petitioners are not named in the first information report and it appears from perusal of case diary as well as impugned order that except confessional statements and suspicion as well as criminal antecedent, there is nothing against the petitioners. Moreover, having more or less similar allegation one co-accused Ramu Kumar@ Ramu Paswan @ Himanshu has already been granted privilege of bail by a Division Bench of this Court vide order dated 20.02.2015 passed in Criminal Appeal (DB) No. 142 of 2015 under conception that the case had been registered under
Patna High Court Cr.Misc. No.50638 of 2014 (5) dt.01-04-2015 3/3 Section 21(4) of the National Investigation Agency Act, 2008. Accordingly, above named, petitioners, namely, Munna Yadav alias Ashok Kumar, Sanjay Rai alias Sanjay Yadav and Ram Bali Paswan, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each respectively to the satisfaction of learned Sessions Judge cum Special Judge, Muzaffarpur and SubDivisional Judicial Magistrate, Muzaffarpur (West), in connection with Sessions trial no. 907 of 2014 corresponding to Sahebaganj P.S.Case No. 175 of 2014.
