The petitioner seeks his bail in Turkaulia (Banjaria) P.S.Case No.455 of 2013 registered under Sections 448, 504, 34 of the Indian Penal Code and Section 3(iv) (v) (xv) of the SC/ST Act. The informant alleged that the petitioner along with other persons came to her hut, abused by caste name, assaulted and threatened to kill her.

It has been submitted on behalf of the petitioner that omnibus and general allegation has been made against the petitioner and that there is no specific overt act against him. It is further submitted that the petitioner has clean antecedent and is in custody since 13.9.2014. Further it has been submitted that vide Annexure-2, co-accused Madan Yadav has been granted bail by this Court.

On behalf of the State it has been stated that the petitioner is named in the FIR.

Considering the facts aforesaid, the petitioner, named

No.15916 of 2015 (2) dt.08-06-2015 2/2 above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia (Banjaria) P.S.Case No.455 of 2013.
