This application, for grant of anticipatory bail, arises out of Vishnupad P.S. Case No. 97/2015, disclosing offences under Sections 420, 467 and 468 of the Indian Penal Code. The petitioner was appointed on compassionate ground after death of his father against Class IV post in Science and Technology Department, Government of Bihar. He is said to have given a certificate of unemployment for the purpose of seeking appointment. The said certificate given by him has been found to be forged and this is the reason behind lodging of the F.I.R.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.43049 of 2017 (2) dt.20-09-2017 2/2 petitioner has submitted that the authorities have wrongly submitted that the said certificate is forged. Be that as it may, considering the nature of accusation, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 97/2015, subject to the condition laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
