JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 This revision application has been field against order dated 22.4.2016 passed by the Principal Judge, Family Court, Araria in Maintenance Case no.263 of 2011, whereby and whereunder altogether Rs.4,000/- per month was allowed to the Opposite Party Nos. 2 and 3 , who are wife and daughter of the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner is still ready to keep her and her son with dignity and care and for that he has to move before the court below itself by filing a petition under Section 127 of the Cr.P.C. and as such he is not pressing present application. Nobody appears on behalf of the Opposite Party No.2 though from the record it appears that Opposite Party No.2 has appeared by filing Vakaltnama.

No.797 of 2016(6) dt.13-08-2019 2/2 In view of the above submission, this Revision Application is dismissed as withdrawn, with liberty to the petitioner to file an application under Section 127 of the Cr.P.C. on the ground that the petitioner is ready to keep her with dignity and care and if such a petition is being filed by the petitioner, the learned Family Court, shall consider the same and will pass appropriate order after hearing both the parties.
