The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The petitioner is not named in the F.I.R. Name of the petitioner firstly came in the confessional statement of Kishore Prasad @ Kishori Sah, father of the petitioner, from whose house, sugar kept in sacs was recovered. Thereafter one Subrati Miyan and Raju Sah are said to have confessed their guilt and, in pursuance thereof, the tractor was recovered. Rajesh Sah and Subrati Miyan have already been enlarged on bail. Except the confession of co-accused, there appears no material on record to show that the petitioner committed the crime.

No.9585 of 2015 (3) dt.24-04-2015 2/2 Considering the facts aforesaid and the fact that the petitioner is in jail since 17.11.2014, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in Ramgarhwa P.S. Case No. 157 of 2014.
