The petitioners apprehend their arrest in a case registered for the offence punishable u/s 304(B)/34/201 IPC and 3⁄4 D.P. Act.
Vide order dated 18.04.2022, petitioners were granted provisional bail by a co-ordinate Bench of this Court and case diary was called for. The same has been received. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The
Patna High Court CR. MISC. No.58335 of 2021(4) dt.21-11-2022 2/2 allegation leveled against the petitioners is not specific rather general and omnibus in nature. It is submitted that husband of the deceased is already in judicial custody. Petitioners are the inlaws of the deceased. Heard the parties and gone through the case diary. From perusal of the case diary, it is clear that there is no specific overt act against the petitioners and husband of the deceased is already in judicial custody, as such, the provisional bail granted to the petitioners vide order dated 18.04.2022, in connection with Sirdala P.S. Case No.56 of 2021, is hereby confirmed, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
