The petitioner apprehends his arrest in connection with Bhore P.S. Case No. 184 of 2017, G.R. No. 2289 of 2017 registered for the offence(s) punishable under section(s) 341, 323, 324, 307, 379, 427, 504/34 of the Indian Penal Code. It has been alleged that on 26.07.2017, this petitioner and 7 others named in the FIR, came at the house of informant and started demolishing his wall and on protest, the accused persons assaulted the informant and his son as well as his daughter-in-law, Rajnita Devi. This petitioner allegedly gave Farsa blow on her head.
The injury report of Rajnita Devi has been annexed as
Patna High Court Cr.Misc. No.37964 of 2017 (2) dt.16-08-2017 2/2 Annexure-2 to this application, which shows that she sustained simple injury caused by hard and blunt substance. Injury report further shows that she sustained injury on 25.06.2017, however the occurrence has been alleged to be dated 26.06.2017. Both the parties are neighbours. A complaint case has also been filed from the side of the petitioner.
Learned Additional Public Prosecutor on the other hand opposed the submission.
Considering the facts and circumstances, as stated above, this application is allowed.
Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Gopalganj in connection with Bhore P.S. Case No. 184 of 2017, G.R. No. 2289 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code. (Sanjay Kumar, J) Mahesh/- U T
