None appears on behalf of opposite party no. 2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 148(C) of 2018 for the offences alleged under Sections 498A, 323, 341, 379 and 354 of the Indian Penal Code.
Learned counsel for the petitioner submits that on the joint prayer of the learned counsel for the parties, the matter was referred to the Patna High Court Mediation Center for mediation and settlement of the dispute between the parties, but, opposite party no. 2 did not turn up before the Mediation Center, due to
Patna High Court CR. MISC. No.76412 of 2018(6) dt.09-08-2019 2/2 that matter could not be settled. The petitioner is still ready to keep his wife with dignity.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Complaint Case No. 148(C) of 2018 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Masaurhi, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
