The petitioner has renewed his prayer for bail in connection with Halsi P.S. Case No. 61 of 2012 (Sessions Trial No. 508 of 2013) registered under Sections 363A/366 of the Indian Penal Code. Subsequently, section 376 of the IPC was also added.

The accusation is of kidnapping the minor daughter of the informant. The victim in her statement recorded under Section 164 Cr.P.C. on recovery stated about the miseries faced by her including sexual assault.

The report of learned Additional District & Sessions Judge-Ist, Lakhisarai dated 23.05.2015 reflects that only

Patna High Court Cr.Misc. No.15519 of 2015 (03) dt.25-06-2015 2/2 I.O. and Judicial Magistrate before whom 164 Cr.P.C. statement of the victim was recorded are left to be examined and the trial is likely to be concluded within a period of three months. Considering the above facts, this Court is not inclined to entertain the present prayer for bail of the petitioner. It is expected from S.P., Lakhisarai to produce the I.O. on the next date fixed, if he has not been examined. It is expected from the learned trial court to conclude the trial within the time frame transmitted to this Court.
