JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-09-2022 The learned counsel for the petitioner is directed to remove all the defects, if any, pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned counsel for opposite party no. 2.

The petitioner apprehends his arrest in connection with Sasaram (T) P.S. Case No. 1044 of 2019 registered for offence punishable under sections 341, 323, 353, 504 and 506 of the Indian Penal Code.

As per allegation, there was an agreement between the informant and the petitioner and as per terms and conditions of the agreement, the petitioner has to deposit first installment of the arrear of Rs. 5,30,916/- and later on, Rs. 3,09,701/- per month. The learned counsel for the petitioner has submitted that he

Patna High Court CR. MISC. No.57215 of 2021(3) dt.05-09-2022 2/2 has cleared dues of Rs. 17,18,202/- till April, 2022. On the other hand, the learned counsel for opposite party No. 2 though fairly admitted that the entire dues till April, 2022 has been deposited, but thereafter again there were dues about Rs.3,00,000/- against the informant.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 1044 of 2019, subject to condition as laid down under section 438(2) of the Code of Criminal Procedure. Further condition is that the petitioner shall deposit the electricity bill regularly. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
