The petitioner seeks bail in Bariyarpur P.S. Case No. 51/2012, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The informant named five persons and alleged that they all made indiscriminate firing. It is further alleged that the petitioner fired which hit on his shoulder. The informant some how fled away.

It is submitted that the independent witnesses have stated different story about the occurrence. There appears that the informant himself has very categorically stated that it was the petitioner who fired and the same hit on his shoulder. The

Patna High Court Cr.Misc. No.13933 of 2015 (5) dt.31-07-2015 2/2 informant got injuries which are grievous in nature. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail at this stage. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within seven months from the date of receipt of this order. If the trial is not concluded within stipulated period, the petitioner may renew his prayer for bail thereafter. (Prabhat Kumar Jha, J.) Rakhi/- U T
