JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-01-2023 Learned counsel for the petitioners seeks permission to withdraw the application with regard to petitioner nos.1 and 2, namely, Sanjay Das @ Sanjay Ravidas and Munarik Mehta @ Mnarik Mahto as they have been arrested.

Heard learned counsel for petitioner no.3, namely Surendra Mehta and learned A.P.P. for the State. Petitioner no.3 apprehends his arrest in connection with Gurua P.S. Case No.150 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Nothing

Patna High Court CR. MISC. No.48003 of 2022(4) dt.23-01-2023 2/2 has been recovered from possession of the petitioner. The alleged recovery has been made from the place near Chalo Hill. The petitioner has got no criminal antecedent. Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let petitioner no.3, namely, Surendra Mehta be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Executive Special Judge, Excise Court No.2, Gaya in connection with Gurua P.S. Case No.150 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
