JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 14.11.2014 in connection with Barbigha P.S. Case No. 257 of 2014 for the offences instituted under Sections 302 and 201 read with Section 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the father of the deceased had solemnized the marriage of his daughter with Rajesh Mahto and she was blessed with three sons and one daughter. The petitioner including other accused persons used to torture her and sometimes they assaulted her because the petitioner had illicit relation with another lady. On 24.07.2014, the father of the deceased got information on his mobile that all the accused persons in collusion with each other killed his daughter and

Patna High Court Cr.Misc. No.15656 of 2015 (2) dt.08-06-2015 2/2 disappeared her dead body.

It has been submitted on behalf of the petitioner that the petitioner is Bhaisur of the husband of the deceased. Further it has been submitted that the petitioner has clean antecedent and he has got no concern with the affairs of the husband of the deceased being separated in mess and property. It has further been submitted that the alleged occurrence is said to have taken place after 20 years of marriage. It has been submitted that the petitioner is in custody since 14.11.2014.

It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Srivastava, Judicial Magistrate, Ist Class, Sheikhpura in connection with Barbigha P.S. Case No. 257 of 2014. (Sudhir Singh, J) B.T/- U T
