2. The present writ petition has been filed for directing the respondent to appoint the petitioner on the post of

Patna High Court CWJC No.11740 of 2012(4) dt.14-12-2023 2/3 constable and include the name of the petitioner in the list of the successful candidates because the name of the petitioner purposely has been left by the authorities.

3. Learned counsel for the petitioner submits that pursuant to the Advertisement No.2/2009 published by respondent no.2 the petitioner has applied for the same and petitioner has fulfill all the requisites qualification as prescribed in the advertisement and thereafter the respondent no.2 has issued admit card to the petitioner for appearing in the examination in question. Petitioner had appeared in the written examination on 01.05.2010 and thereafter the petitioner has appeared in the physical examination test on 23.09.2010 and after all the test the petitioner declared successful in physical test but in the final selection list name of the petitioner does not figer.

4. Learned counsel for the respondent no.2 to 4 (Central Selection Board of Constable) submits that the petitioner is belong to the Extremely Backward Female Non Home Guard (EBC-F-NHG) category and she has secured lesser marks than the last recommended candidate in her category and the petitioner had secured only 8 marks and the cut off marks in her category was 29 marks, so name of the petitioner does not

5. It is admitted position that the petitioner has awarded lesser mark than the last selected candidates who has been awarded 29 marks, so that the authority had rightly not selected the petitioner for the post in question.

6. There is no merit in the writ petition. Accordingly dismissed.
