The petitioner seeks bail in a case registered for the offence under Section 272, 273 of the I.P.C., Section 30(a) of Bihar Prohibition and Excise Act and Section 20/22 of the N.D.P.S. Act.

10 liters of country-made liquor and 1 kg. Ganja have been recovered from possession of the petitioner. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The recovered Ganja is of small quantity. Mandatory provision with regard to search and seizure has not been followed. Petitioner is in custody since 28.09.2020. Chargesheet has been submitted.

Patna High Court CR. MISC. No.57813 of 2021(2) dt.17-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Ahiyapur P.S. Case No. 771 of 2020.
