Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in Barauli Police Station (for brevity, PS) Case No 45 of 2020 dated 23.02.2020 instituted for the offence punishable under Sections 399, 402, 411, 413, 414 of Indian Penal Code, Section 25 (1-b)a/26 (i) (2)/35 of Arms Act and Section 8 (C), 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act.
500 Grams of Ganja, 2 cartridges, one motorcycle and a mobile phone have been recovered from the petitioner. It is submitted that the petitioner is in custody since
Patna High Court CR. MISC. No.4537 of 2021(2) dt.23-06-2021 2/3 22.02.2020. The petitioner is accused in two other cases, as per details given in paragraph 3 of the application, in which it is submitted that he is on bail. Co-accused Risu Raman Singh @ Somar Singh @ Bikku, having similar allegations as the petitioner, has been allowed bail by this Court in Cr Misc No 36769 of 2020, having regard to the period of custody. The learned counsel submits that petitioner pleads false implication and due to his criminal antecedents, he has been implicated in this case also.
Learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Gopalganj in connection with Barauli PS Case No 45 of 2020 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on
Patna High Court CR. MISC. No.4537 of 2021(2) dt.23-06-2021 3/3 each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
