The petitioner seeks pre-arrest bail in connection with Murliganj P.S. Case No. 157 of 2014 registered under Sections 341, 342 and 354 read with 34 of the Indian Penal Code.
Regard being had to the fact that the FIR is based on a complaint, which was referred to the police for investigation under Section 156(2) of the Code of Criminal Procedure and the complaint was instituted after five days of the alleged occurrence and in course of investigation the police found the
Patna High Court Cr.Misc. No.41611 of 2017 (2) dt.19-09-2017 allegation made under Section 376 of the Indian Penal Code to be not true and charge-sheet has been submitted only for the offences punishable under Sections 341, 342 and 354/34 of the Indian Penal Code, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.157 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C., in the event of arrest or surrender in the court below within four weeks from today.
