The petitioner apprehends his arrest in Saraiya P.S. Case No. 264 of 2016 under Section 406 and other sections of the Indian Penal Code.

The Block Education Officer, Saraiya, Muzaffarpur, alleged that the petitioner being Panchayat Secretary of Gram Panchayat Raj, Ram Krishana, Dubiyahi, Muzaffarpur, did not hand over the registers, merit lists of the teachers, appointed from the years 2003 to 2010.

The learned counsel for the petitioner submits that the petitioner joined Gram Panchayat Raj, Ram Krishana, Dubiyahi, Muzaffarpur, in the year 2011 and his predecessor did not hand over the folders, registers and merit lists of the teachers appointed during the years 2003 to 2010.

Considering the facts, aforesaid, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with
