JUSTICE AMARESH KUMAR LAL ORAL ORDER 26-02-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody since 28.11.2014 in a case registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.

It is submitted that the name of the petitioner has appeared in the statement of the co-accused Manoj Goswami from whose possession, the theft articles were recovered. No Test Identification Parade has been held against the petitioner. Nothing has been recovered from the possession of the petitioner. The petitioner is an old man having no criminal antecedent. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on

Patna High Court Cr.Misc. No.6695 of 2015 (2) dt.26-02-2015 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 969 of 2014 with the following conditions:

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J.) Vats/- U T
