2. The petitioner is seeking regular bail in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 172 of 2024 for the offences punishable under Sections363, 366A of the Indian Penal Code and Sections 8, 12 of the POCSO Act.

3. As per allegation, on 20.02.2024, the informant's daughter went to appear in matric examination from his house but she did not return. It is further alleged that at the instance of co-accused Punam Devi, Lakhichan Ram came to his house and demanded his mobile and apprised that her daughter had fled away with the petitioner.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.51653 of 2024(2) dt.30-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the age of the victim as per medical report is between 17 to 19 years and in her statement recorded under Section 164 of the CrPC, she did not make any allegation against the petitioner. He has further submitted that the petitioner is a person of clean antecedent and is under custody since 06.03.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 172 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
