The petitioner apprehends his arrest in Ahiyapur P.S. Case No. 373 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that while he was offering prayer in Gaushiya Masjid somebody fired at him. The informant himself suspected that his maternal uncle has got land dispute with him and he might have fired.

Learned counsel for the petitioner submits that the informant has only suspected that the petitioner might have fired on account of land dispute. There is no eye witness of the occurrence. Nobody has seen the petitioner at the place of

Patna High Court Cr.Misc. No.5986 of 2015 (2) dt.12-02-2015 2/2 occurrence. Except suspicion, the police has not yet collected any tangible evidence.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 373 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
