JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2019 At the outset, the learned counsel appearing for the petitioner seeks to withdraw the present writ petition with liberty to move the competent court of civil jurisdiction for grant of appropriate relief in view of the fact that disputed and complicated question of facts and law are involved, which are required to be adjudicated by an appropriate court having competent civil jurisdiction. The learned counsel for the petitioner further submits that the petitioner be granted liberty to seek compensation for his land usurped by the respondent authorities for the purposes of construction of road, in case a declaration is

Accordingly, the writ petition stands disposed of as withdrawn with the aforesaid liberty, as also liberty to the petitioner to seek compensation from the respondent-State authorities as and when a declaration is made in his favour with regard to the title of the said land.
