JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 3575 of 2015, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code.
Allegation as per complaint petition is that the mother of the petitioners executed a sale-deed in favour of the complainant with respect to a piece of land, but later on it was found at the time of mutation that the land is not in the name of mother of the petitioners, rather it is in the name of elder brother of the petitioners.
Submission of learned counsel for the petitioners is that they are only witness on the sale-deed and furthermore the parties
Patna High Court CR. MISC. No.77632 of 2018(4) dt.17-05-2019 2/2 have amicably settle the dispute by entering into a compromise. Further submission is that the mother of the petitioners along with other accused person have already been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 12.04.2019 passed in Cr. Misc. No. 23775 of 2019. Heard learned A.P.P. also.
In this case earlier notice was issued to the opposite party no.2 and the same has been received by the son of the opposite party no.2 on permission of the complainant. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in connection with Complaint Case No. 3575 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
