02. In the present case, the petitioner seeks bail in connection with Lalganj P.S. Case No. 329 of 2023 registered for the alleged offences under Sections 341, 323, 324, 325, 379, 307, 504, 506/34 of the Indian Penal Code.

As per prosecution case, petitioner and other coaccused persons had been assaulting the maternal grandson of the informant and when the informant and his brother, son and nephew came to his rescue, the petitioner and others assaulted them with bhala, lathi and sword, causing a number of injuries to their victims.

04. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.55566 of 2025(3) dt.03-11-2025 2/3 petitioner is innocent and has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken place. Earlier on 18.09.2023, the petitioner was brutally assaulted with intention to kill him by the informant and his family members and the petitioner lodged Lalganj P.S. Case No. 328 of 2023 under Sections 341, 323, 307/34 of IPC against the informant and others and the informant has lodged the present case only with a view to save himself and his family members. Learned counsel further submits that all the offences are bailable in nature except Section 379 and 307 of IPC, but no offences under Sections 379 and 307 of IPC is made out against the petitioner from the facts of the case.

Co-accused Renu Devi has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 14.03.2024 passed in Criminal Misc. No. 16050 of 2024. Learned counsel further submits that the allegation of assault is not specific and the injuries sustained by the victim appear to be superficial. The petitioner is in custody since 26.11.2024 and charge-sheet has been submitted. Learned counsel further submits that prior to lodging of the present FIR, the petitioner has got no criminal history, although he has been made accused in two cases thereafter.

05. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.55566 of 2025(3) dt.03-11-2025 3/3 bail.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/court concerned in connection with Lalganj P.S. Case No. 329 of 2023, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
