Patna High Court CWJC No.13142 of 2016(3) dt.28-11-2018 2/2 to withdraw the present petition in order to enable the petitioner to prefer an appeal against the impugned order under the provisions of Section 11 of the Passports Act, 1967 (in short the Act).
Mr. Agrawal, learned Senior Advocate, has further made a submission that because of his having approached this Court twice, the present petition being in the second instance, he has lost out on the time limit prescribed under the Act for preferring the appeal.
Should such an appeal be filed, within a period of 30 days from today, along with an application for condonation of the delay, if required, the same shall be considered by the Appellate Authority and the appeal shall be heard.
With the aforesaid observation, the writ petition stands disposed of.
