JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-07-2021 Heard Mr. Virendra Kumar, learned counsel for the petitioner and Mr. Ashok Kumar Sinha, learned counsel for the complainant through video conferencing.

The present application has been filed for grant of regular bail to the petitioner in connection with Complaint Case No. 313(C) of 2018 registered for the offence under Section 498(A) of the I.P.C. and Section 3/4 of the Dowry Prohibition Act.

This is 2nd attempt for bail on behalf of the petitioner, who is the husband of the complainant and the allegation against him is that he subjected the complainant to cruelty and demanded dowry and also ousted the complainant from the matrimonial home due to non -fulfillment of the demand. Learned counsel for the petitioner submits that petitioner is in custody since 18.2.2020 and now the matter has

Learned counsel appearing for the Opposite Party No. 2 accepts that the parties have come to amicable settlement. In view of the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 18.2.2020, the parties have already compromised and have arrived at amicable settlement, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur, District - Patna in connection with Complaint Case No. 313 of 2018.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
