JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 395, 396, 397 of the Indian Penal Code.

Petitioners are not named in the first information report but in course of investigation, some witnesses claimed that at the time of dacoity, the dacoits were taking name of these petitioners and others and thereafter, one co-accused, Baliram Bind confessed his guilt disclosing the name of petitioners as his associates.

Patna High Court Cr.Misc. No.24751 of 2016 (3) dt.20-06-2016 2/2 Submission on behalf of the petitioners is that having similar allegation, several co-accused have already been granted privilege of bail and as a matter of fact, except the above stated circumstance, there appears to be nothing against the petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Saran in connection with Doriganj P.S. Case No. 96 of 2015.
