2. The present application has been filed for quashing the letter no. SCN/316363592/20 dated 12.08.2020, letter no. IMP/316577646/20 dated 18.09.2020 and letter no. REM/318475526/21 dated 30.09.2021 by which the grievance of the petitioner for re-issuance of passport was not considered.

3. The petitioner had applied for renewal of passport by suppressing the criminal case. Now the petitioner submits that in view of the law laid down by the Hon'ble Supreme Court in the case of Dhiren Baxi vs. Regional Passport Officer reported as AIR 2003 Gujarat 108. Learned counsel further submits that he may be allowed to reapply in accordance with

Patna High Court CWJC No.10631 of 2023(4) dt.09-01-2024 2/2 the law laid down by the Hon'ble Supreme Court and the different High Courts.

4. This application is disposed of with liberty to the petitioner to reapply in accordance with law after seeking permission from the criminal Court.

5. If such an application is filed, the Regional Passport Officer or his/her subordinate may take a decision in accordance with law whether to renew the passport of the petitioner or not.

6. With the aforesaid observations and directions, this application is disposed of.
