JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught red handed while taking bribe of Rs. 20,000/-. It is submitted that although charge sheet has been submitted against the petitioner but prosecution failed to produce any sanction order and, moreover, the first information report and other documents go to show that on 18.03.2016, the allegation maker reported to the vigilance officials about the so called illegal demand and on the same day, trap team was constituted and petitioner was arrested and, therefore, the aforesaid circumstance goes to show that the entire prosecution case was manufactured by vigilance officials at the behest of enmity with the petitioner but I am not, at all, convinced with the aforesaid submissions and,

Patna High Court Cr.Misc. No.25610 of 2016 (2) dt.21-06-2016 2/2 accordingly, I am not inclined to grant privilege of bail to the petitioner and, hence, his prayer for bail in connection with Special Case No. 16 of 2016, Vigilance P.S.Case No. 33 of 2016 , pending in the court of Special Judge, Vigilance, North Bihar, Muzaffarpur, stands rejected, at least, at this stage.
