JUSTICE PURNENDU SINGH ORAL ORDER 24-06-2024 Heard Mr. Rajeev Kumar Singh, learned counsel along with Mr. Vijay Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Mankeshwar Tiwari, learned AC to AAG-3 for the State.

Learned counsel appearing on behalf of the petitioner referring to Annexure-3 in support of the appointment of the petitioner on compassionate basis after recommendation of the District Compassionate Committee submitted that since the date of appointment i.e. 06.06.1992 the petitioner was regularly working and had never absented from the work and

Patna High Court CWJC No.19544 of 2012(3) dt.24-06-2024 2/2 she was also paid applicable pay scale as it would appear from Annexure-4 to the writ petition. Learned counsel submitted that no reason has been assigned, as to why, the authorities have restrained taking work from the petitioner who was appointed as Safai Majdoor.

Considering the relief sought for in the present writ petition, as well as, the fact that the petitioner has been able to bring on record the appointment letter dated 06.06.1992, I find it proper that the petitioner, if so advised, may file a detailed representation before the Municipal Commissioner, Patna Municipal Corporation for considering her relief as prayed for in the present writ petition taking into consideration the appointment letter issued under the signature of the then Administrator, Patna Municipal Corporation.

4. The representation of the petitioner is required to be duly considered and appropriate action be taken, if the petitioner is entitled for the reliefs as prayed for in the present writ petition expeditiously.

5. The writ petition stands disposed of.
