JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 21.01.2015 in a case registered for the offences punishable under Sections 376, 493 of the Indian Penal Code on the accusation that he established physical relation with the informant on false promise of marriage. The informant claimed that she was in physical relation with the petitioner since last three years but learned counsel for the petitioner drew my attention towards Annexure-2 to this petition and submits that prior to institution of the present case, the informant lodged a case against the petitioner for making attempt to commit rape on her.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.14905 of 2015 (4) dt.30-06-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Gopalganj in connection with Gopalganj Mahila P.S. Case No. 05 of 2015.
