2. The petitioner seeks bail in a case registered for the offence punishable under Sections-25(1-b)a, 26 of the Arms Act.

3. Allegedly, a double barrel gun and threelive cartridges were recovered from possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that the petitioner has got no criminal antecedent. It has also been submitted that the petitioner is in custody since 20-05-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances,

No.50249 of 2024(3) dt.26-10-2024 2/2 especially the clean antecedent of the petitioner as also the fact that he is in custody for more than five months, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Bikramganj, Rohtas in connection with Dawath P.S. Case No. 173 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
