The petitioner is facing accusation punishable under sections 406,409 and 420/34 IPC. The Block Education Officer, Forbesganj lodge the FIR alleging therein that a sum of Rs. 12,92,850 was sanctioned to the petitioner being the Headmaster of the school for construction of class rooms. On query, it was found that construction work was not completed and some inferior/substandard materials were being used. Counsel for the petitioner submits that subsequently the Block Education Officer himself inspected the construction site and found that at least work worth Rs. eight lakh and odd was

Patna High Court Cr.Misc. No.10943 of 2015 (3) dt.21-05-2015 2 / 2 executed. It is submitted that the remaining amount is already standing in the bank account of the school in question. He relied in this regard on the photo copy of the pass book. The petitioner is in custody since 16.12.2014.

In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Forbesganj P.S. Case No. 767 of 2014 (G.R.No.4094/2014) on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge the petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates the bail bonds of the petitioner shall stand cancelled.
