Sri Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 Heard Sri Prem Kumar Jha, learned counsel for the petitioner and Sri Arun Kumar Pandey, learned Additional Public Prosecutor.

The sole petitioner apprehending his arrest in Dehri ( Indrapuri) P.S. Case No. 460 of 2017 registered for the offence under section 186, 183, 323, 341, 504, 506, 307, 353, 332 & 333 of the Indian Penal Code , 1860 and Section 30(a) , (b), 34 & 45 of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that it is a peculiar case in which unauthorisedly Police tried to intrude into the house of the petitioner and when Police was prevented the petitioner has been made accused. From the FIR

Patna High Court Cr.Misc. No.42333 of 2017(2) dt.21-09-2017 2/2 it is evident that one accused carrying liquor after seeing the Police fled away and it was alleged that the said person trying to save him entered into the house of the petitioner. Besides this, it has argued that petitioner is having clean antecedent . This fact has been mentioned in paragraph - 3 of the petition. Considering the nature of accusation and clean antecedent of petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Sanoj Kumar Singh @ Dheman Singh @ Doman Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II - cum - Special Court, Excise, Rohtas / concerned court in connection with Dehri ( Indrapuri ) P.S. Case No. 460 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure , 1973 .
