The dispute between the parties is pending in the Bihar Land Tribunal by way of restoration application. Learned counsel for the petitioner submits that the same may be directed to be heard and decided expeditiously. Learned counsel for respondent No. 7 also has no objection to the same.

In these circumstances the order dated 11.07.2019 which is an order of dismissal for non prosecution is quashed in the interest of justice.

The main case that is BLT case No. 275 of 2016 is restored. The same may be decided by an appropriate Bench of the Bihar Land Tribunal in accordance with law preferably within six months from the date of communication of the order of this Court.

Patna High Court CWJC No.11963 of 2022(4) dt.10-11-2022 2/2 The parties will appear on 24th of November, 2022 before the Bihar Land Tribunal and thereafter a date shall be fixed by the BLT and the case will be decided. During the pendency of the case in Bihar Land Tribunal, the possession of the petitioner shall not be disturbed. With the aforesaid observation and direction, this application is disposed of.
