2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 379, 504 and 506/34 of the Indian Penal Code.
3. As per prosecution case, this petitioner, armed with pistol, sexually harassed the victim.
4. It is submitted that both parties are gotiyas and due to dispute over share in the property, this false and concocted case has been lodged against the petitioner with a view to harass the petitioner and grab his ancestral property. No such occurrence as alleged in the F.I.R. has ever taken place.
5. Considering the backdrop of the case and relationship between the parties, this anticipatory bail is allowed
Patna High Court CR. MISC. No.48602 of 2023(2) dt.22-08-2023 2/2 and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- 16th, Vaishali at Hajipur in connection with Tisiauta P.
