Informant, who happens to be the father of the deceased Vikrant gave his fardbeyan on 13.01.2016 disclosing therein that on 11.01.2016, Vikrant had gone along with his friends. In the night at about 10-11 p.m., he received telephonic information wherein he came to know that during course of drinking wine, deceased had developed quarrel with the villagers of village-Mashari and during course thereof, he was murdered and his dead body had been disposed of. Furthermore, he came to know with regard to assailants apart from others i.e. Bahadur Manjhi, Kamlesh Manjhi, Gorakh Manjhi, Mukesh Manjhi, Ranjan Manjhi, Sunny Manjhi, Dudheshwar Manjhi, Satyendra

Apart from this, all the witnesses who ever been examined uptill now happens to be the hearsay witnesses. None had claimed to be an eye-witness. Consequent thereupon, petitioner namely Gorakh Manjhi is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. case no. 03/2016.
