JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Petitioner is permitted to make necessary correction in para-9 of the petition within course of the day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.
Petitioner is in jail custody since 21.12.2015 on the accusation that one country made loaded pistol was recovered from his conscious possession. Petitioner does have criminal antecedent of seven cases but submission on behalf of the petitioner is that prior to institution of the present case, petitioner had been made accused only in four cases but after institution of
Patna High Court Cr.Misc. No.23782 of 2016 (3) dt.13-07-2016 2/2 the present case he was remanded in three other cases which had been lodged against unknown persons. It is also pointed out that moreover, having more or less similar allegation, co-accused, Chamru Bind has already been granted privilege of bail by this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 455 of 2015.
