The petitioners seek regular bail in a case under sections 406, 420 and other allied sections of the Indian Penal Code.

The informant alleged that the petitioners took money from him on the pretext of providing him job. The informant deposited Rs.50,000/- in the account of Sitaram Patwari, petitioner no. 1 on different dates and thereafter on the request of Sitaram Patwari the informant and others deposited a huge amount of Rs.8,54,000/- in the account of Mamta Kumari. It is submitted that the petitioners have been cheated. One Shesh Nath Pujari is the king pin and he along with his gang men persuaded the

Patna High Court Cr.Misc. No.9332 of 2015 (4) dt.14-05-2015 informant and other villagers to deposit money in the account of Mamta Kumari, who is the broker of Shesh Nath Pujari. The petitioners are ready to return Rs.50,000/- which they received from the informant.

Considering the facts aforesaid, the above named petitioners Sitaram Patwari and Bhikhari Patwari are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B. K. Rai, Judicial Magistrate, 1st Class, Bagaha, WestChamparan in connection with Laukariya P.S. Case no. 104 of 2014 subject to the condition that the petitioners shall return Rs.50,000/- (Fifty thousand) to the informant within one month from the date of their release from custody. If the petitioners fail to give money to the informant, the learned court below shall cancel the bail bond of the petitioners. (Prabhat Kumar Jha, J) Amin/- U
