Petitioner seeks bail in Ahiyapur P.S. Case No.747 of 2018 instituted for the offence under Section(s) 379, 411 Indian Penal Code.

Counsel for the petitioner submits that Petitioner is in custody since 14.07.2018 having clean antecedents. It is alleged in the written report that informant parked his GLAMOUR motorcycle at the door and went to Muzaffarpur market. When he returned from market, he got information about theft of his motorcycle. The informant made search and got information that his motorcycle is parked in front of market of Garhara Mukhiyajee. The informant reached there

Patna High Court CR. MISC. No.45987 of 2019(2) dt.30-07-2019 2/2 and found his motorcycle parked. He got information from nearby people that this petitioner along with Dinesh Sahni has come on the aforesaid motorcycle. They were talking about selling the motorcycle. The informant informed the police. The patrolling party reached there. Petitioner and Dinesh Sahani started to run away from the said motorcycle, but they were apprehended by the police.

In this manner, from the narration in the written report, mere vague allegation has been levelled against the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Ahiyapur P.S. Case No.747 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
