JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioners are languishing in custody since 24.10.2014 and 27.10.2014, respectively, in connection with Nardiganj P.S. Case No. 123 of 2014 for the offences instituted under Sections 341, 323, 427, 324, 307, 504 and 379 read with section 34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that on 11.08.2014 the informant along with his sons, namely, Gungun Singh and Mantu Singh, went to his field and in the meantime, petitioners and one Sanjay Manjhi started abusing them and petitioner no.2 uprooting the paddy crops from his field which was protested by the informant on which petitioner no.2 assaulted Gungun Singh with Khanti on his head due to which he received head injury and

No.15719 of 2015 (2) dt.08-06-2015 2/3 thereafter Mantu Singh tried to save his brother, petitioner no.1 assaulted him with Garasa on his head due to which Mantu Singh sustained head injury. Sanjay Manjhi gave bhala blow on the back of Mantu Singh and also assaulted on the cheek of Gungun Singh. Petitioner no.2 snatched gold chain from the neck of Gungun Singh and Petitioner No.1 also snatched a gold chain from the neck of Mantu Singh.

It has been submitted on behalf of the petitioners that the alleged occurrence is said to have taken place for oblique reason and in course of hot exchange of words, it is alleged that the petitioner no.1 had given single blow and as far as petitioner no.2 is concerned, he is alleged to have given Khanti blow upon Gungun Singh. Further it has been submitted that the petitioners have no criminal antecedents and they are in custody since 24.10.2014 and 27.10.2014, respectively.

It has been submitted on behalf of the State that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge III, Nawada in S.T.
