The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 56 of 2022 registered under Sections 363, 366A and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that victim girl in her statement recorded under Section 164 of Cr.P.C. stated that she voluntarily left her house and went to Nepal with the petitioner where they resided in a rented room for five days. Later on she solemnized marriage with the petitioner. It is also submitted that petitioner has got no criminal antecedent. Having considered the facts and circumstances of the

Case No. 56 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
