JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. The informant specifically claims in his ferdbeyan that two unknown persons made indiscriminate firings causing death of deceased, Niranjan Singh and, accordingly, the present case was lodged against two unknown persons. Admittedly, petitioner is co-villager of the informant. In course of investigation, the name of petitioner came in confessional statement of co-accused, Surendra Singh and except the aforesaid confessional statement, there appears to be nothing against the
Patna High Court Cr.Misc. No.23706 of 2016 (3) dt.12-07-2016 2/2 petitioner. It is also pointed out that co-accused, Surendra Singh has already been granted privilege of bail by a co-ordinate Bench of this Court and apart from this, some other accused, having more or less similar allegation, have also been released on bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 41 of 2013 corresponding to G.R. No. 187 of 2013.
