2. Heard the parties.

3. The present petition has been preferred for the following relief/s:

(i) for issuance of writ of mandamus directing the respondent no.3 to complete the process of mutation in favour of the petitioner on the basis of certificate of sale dt 27.06.2022 duly registered and entered in Book No.1 as per Section 89(4) of

2/4 Registration Act, 1908 by Registering Authority Govt. of Bihar, Patna;

(ii) the petitioner further seeks direction to District Magistrate, Patna to enquire why application for mutation dt. 09.11.2025 submitted alongwith relevant documents was not considered and disposed of by Circle Officer, Bihta, especially when the right title and interest in the property is affirmed by competent court and the order of the court has attained finality;

(iii) the petitioner further prays for issuance of any other writ/writs order/orders and direction/ directions for which petitioner may be found entitled.

4. The land details stand incorporated in para-5 and read as under:

(i) khata no. 360, 359, 354, 174, 133;

(ii) area - 1 bigha 7 katha;

(iii) survey plot no. 257, 261, 263, 265, 264;

(iv) thana no. 59, Pargana Maner,

5. Pursuant to the judgment and order dated 06.05.2022 passed by the Debt Recovery Tribunal, Bihar (henceforth for short 'the DRT') in S.A. No. 18 of 2021 (M/s Priyadarshi Motors Pvt. Ltd. vs. the State Bank of India & Ors.), the auction took place and the petitioner came into shoes of the said property. Accordingly, the documents were signed by the State Bank of India in favour of the petitioner.

6. Armed with the said order, the petitioner preferred petition before the Circle Officer, Bihta, Patna on 26.07.2023. This led to Measurement Case No. 19/23-24 before the Circle Officer, Bihta, Patna.

7. Learned counsel for the petitioner submits that almost three years have lapsed but the Circle Officer, Bihta, Patna (respondent no.03) is sitting over the matter.

8. Learned State counsel submits that if not concluded, it will be taken to its logical conclusion in accordance with law.

9. The entire facts have been recorded which also shows how the revenue authorities at the ground level are working despite the specific instruction of the State Government to act immediately and see to it that there remains

4/4 zero pendency. This is one such case.

10. In that background, with the consent of the parties, the writ petition is disposed of directing the Circle Officer, Bihta, Patna to immediately take up the matter if still not disposed of and ensure that the entire process is completed within a period of four weeks from the date the copy of the order is received in his/her office to avoid contempt.
