2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that the petitioner was a member of the unlawful assembly during which coaccused Dharmendra Rai caused firearm injury to the mother of the informant as a result of which she died.

4. Learned counsel for the petitioner submits that the petitioner has been implicated merely on the allegation of being a member of the MOB and that there is no specific allegation of

It is further submitted that similarly situated co-accused persons namely, Ram Vivek Rai and Pappu Rai have been extended the privilege of bail by a coordinate Bench of this Court vide order dated 10.12.2020 passed in Cr Misc. No. 31211 of 2020 and the case of this petitioner stands on the same footing. Moreover, the petitioner is languishing in judicial custody since 28.02.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bachhwara P.S. Case No. 210 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai.
