JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sangrampur P.S. Case no. 73 of 2017, registered under Sections 379 and 411 of the Indian Penal Code and Section 4 / 40 of Bihar Mines Mineral Control Rules.

The accusation is that on receiving secret information about carrying of illegal extracted sand loading on the tractor, the informant being the Officer-in-Charge of Sangrampur reached at main road of Sangrampur and seized one tractor attached with the trailer bearing No. BR-0843599 loaded with sand. The driver of the vehicle succeeded to flee away.

Learned counsel for the petitioners submits that both

Patna High Court Cr.Misc. No.39581 of 2017 (4) dt.07-12-2017 2/2 petitioners are driver and owner of the tractor and on the basis of valid chalan the sand was being carried by the petitioners. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.II, Munger in connection with Sangrampur P.S. Case No. 73 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
